SHARE Act Passes U.S. House

Early this afternoon, the U.S. House of Representatives by a decisive 242-161 vote passed H.R. 2406, the Sportsmen's Heritage and Recreational Enhancement (SHARE) Act. See how your House member voted.

Because the SHARE Act is the most important pro-sportsmen and pro-hunting legislation in a generation and a top priority for NSSF, we scored the vote. Twelve Democrats joined the Republican majority to ensure passage. Only four Republicans voted against HR 2406. All attempts to amend the legislation with unfavorable provisions were defeated. Favorable amendments were passed.

Hillary Clinton's Gun Industry 'Immunity' Politics

Hillary Clinton's campaign trail claim that the Protection of Lawful Commerce in Arms Act confers gun manufacturers with “immunity” constitutes a drive-by attack on the firearms industry, writes legal scholar Victor E. Schwartz in today's Wall Street Journal. “The notion that Congress gave gun manufacturers inappropriate immunity from lawsuits is a fiction. Instead the 2005 law stands for the unremarkable premise that when a business makes or sells a lawful product, but the product is used in an unlawful way, it is not the fault of the maker or seller. It is the fault of the criminal,” Schwartz explains. Clinton is using the spurious argument as a way of bludgeoning rival Vermont Senator Bernie Sanders, who voted for the act.

 

House-Passed Bill Would Help Keep Suits in Federal Court

The U.S. House of Representatives Thursday approved on a 229-189 vote an NSSF-supported bill that provides federal judges increased discretion to remove local defendants that are often small businesses from lawsuits filed by trial lawyers attempting to keep cases in more favorable state court jurisdictions. H.R. 3624, the Fraudulent Joinder Prevention Act, would require plaintiffs to demonstrate that their claims are plausible and brought in good faith. Sponsors argued the measure would save small business the considerable time and money now required to deal with lawsuits filed against them as part of attempts by trial lawyers to keep lawsuits in a state court.

To believe the latest report from the Violence Policy Center is to believe that Americans who would like to safely introduce their children to the shooting sports are aiding and abetting what will become a lifelong addiction to firearms with likely violent or self-destructive results. We have long known that gun prohibitionists were borrowing heavily from the anti-tobacco playbook. Now, at least, one long-time gun control propagandist is being open about it. The NSSF's Larry Keane takes him on.


 

Suppressor Bill Passes House in Iowa

House File 2279 was approved earlier this week by the Iowa House of Representatives on a 74-24 vote. Supported by NSSF, HF 2279 would legalize the ownership and use of suppressors. Currently, 41 states allow for the lawful possession and use of suppressors, and 38 states allow suppressors to be used for hunting. HF 2279 has been transferred to the Iowa Senate, where it has been assigned to the Senate Judiciary Committee.

 

Kansas House Approves Right to Hunt and Fish Bill

The Kansas House of Representatives approved HCR 5008 this week by a vote of 117-7. HCR 5008 would guarantee the right to hunt, fish and harvest wildlife in that state. The language included in HCR 5008 would protect the use of traditional methods and promote wildlife management and conservation, thereby creating a permanent safeguard for sportsmen and conservation in Kansas.

 

Defendants Argue for Suit Dismissal based on PLCAA

A Connecticut Superior Court judge heard arguments this week in the civil case of brought against Remington Arms Company and a firearms retailer on the issue of whether the suit should be dismissed. Plaintiffs argued the novel theory that Remington's marketing the AR-15 subjects the company to liability for the tragic 2012 shooting at Sandy Hook Elementary School. In court, Remington's attorney argued that the Protection of Lawful Commerce in Arms Act (PLCAA) applies to this case and requires dismissal because plaintiffs seek to hold defendants liable for the criminal and unlawful misuse of their product. The judge is expected to rule on this motion within 60 days.

 

Brady on Government's Side in Defense Distributed Case

The Brady Center to Prevent Gun Violence has filed an amicus brief in support of the government in the case of Defense Distributed v. U.S. Department of State, which challenges actions by the State Department to prevent the plaintiff from publishing data files containing information necessary to create a 3-D printed firearm via the Internet. The Brady Center's brief argues that 3-D printed firearms are neither in common use nor typically possessed for lawfully purposes, thus not entitled to protection under the Second Amendment. They further argue that by permitting dissemination online of the information the plaintiff seeks to publish will exacerbate international gun trafficking, which could in turn lead to dangerous consequences for the nation's counter-terrorism and foreign relations efforts.

 

Alabama Pistol Permits Qualify for NICS Exception

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has determined that the State of Alabama's concealed carry permit, issued on or after August 1, 2013, qualifies as an exception to a NICS background check for the permit holder. ATF has issued an open letter to Alabama firearms retailers.
